1. Introduction

Welcome to our website for Dolphin's Cove ("Site"). These Terms and Conditions ("Terms") govern your use of our Site and the booking of our holiday home in Jeffreys Bay ("Property"). By using this Site, you agree to comply with and be bound by these Terms.  The Property is management by an Agent that is responsible for bookings and any other issues related to the management of the maintenance and upkeep of the Property.

2. Booking Terms

  • Reservations: To secure a booking, you must provide accurate personal information and pay the required deposit.
  • Payment: Full payment must be received within the specified time frame after booking confirmation and prior to check-in.
  • Cancellation Policy:
    • Peak (Dec-Jan): Cancellations made more than 60 days prior to the check-in date will receive a full refund of the deposit.
    • Off-Peak : Cancellations made 45 days prior to the check-in date will receive a full refund of the deposit.
    • Cancellations made less than 15 days prior to the check-in date will not receive a refund.

3. Guest Responsibilities

  • Property Use: Guests are responsible for keeping the Property in good condition during their stay. Any damages or loss must be reported to the Agent immediately.
  • Occupancy Limits: The Property may only accommodate the number of guests specified in the booking. Unauthorized guests may result in additional charges or termination of the stay.
  • Use of Balcony/Deck: The Property has a deck certified to carry no more than 10 persons. The balcony can carry up to 6 people at any given time, and Guests are responsible to ensure that capacity limits are not exceeded during their stay on the Property.

4. Liability Limitation

  • The Property owner, Agent and/or website operator are not liable for any injuries, losses, or damages incurred during your stay, except where such liability cannot be excluded by law.
  • All information on the Site is provided "as is" and may be subject to change. Although we make every effort to be as transparent and timely with the information published on the Site, we do not guarantee the accuracy, completeness, or reliability of the information. ormation.

7. Indemnity

By confirming your booking, the Guest agrees to indemnify and hold harmless the Property owner, and their respective agents, employees, and representatives from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) arising from any injury, loss, or damage suffered by the Guest, their invitees, or any third party during the rental period, regardless of the cause, except in cases of gross negligence or willful misconduct by the Property owner.

8. Force Majeure

We are not liable for any failure to fulfill our obligations under these Terms due to events beyond our control, including but not limited to natural disasters, strikes, or government actions.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting on this Site. Your continued use of the Site after any modifications indicates your acceptance of the revised Terms.
